This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook/Instagram. You understand that you are providing your information to World Threads, Inc. dba Eberjey (“Sponsor” or “Eberjey”) and not to Facebook/Instagram.  

 

  1. ELIGIBILITY. The Head In The Rose Clouds Sweepstakes Giveaway (the “Giveaway”) is open to individuals who, as of the date of entry, are legal residents of and residing in the United States who are 21 years of age or older. Employees of Sponsor and its affiliates, sales representatives, agencies, dealers, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in the promotion, and the immediate family (parent, spouse, sibling, child, grandparent, grandchild) and household members of all such employees, are NOT eligible. The Giveaway is subject to all federal, state and local laws and regulations. Void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement and acceptance of these Official Rules and of the decisions of Eberjey which are final and binding on all matters pertaining to this Giveaway. If these rules differ from any promotional or other materials published in connection with the Giveaway, these rules shall control. 

 

  1. HOW TO ENTER AND GIVEAWAY ENTRY PERIOD. 

 

To enter the Giveaway: 

 

  • Follow all participating brands: @eberjey, @atian.gin, @mariobadescu 
  • Like the giveaway post  
  • Tag another Instagram account holder in the comments 
  • *Receive a bonus entry if you add the giveaway post to Instagram Stories and tag all participating brands @eberjey @atian.gin @mariobadescu within the entry period 

 

Giveaway Period is between September 6, 2022 at 7AM EST and September 8, 2022 at 11:59PM EST. 

 

Six (6) winners (2 from each participating brand’s comments) will be chosen at random on September 9, 2022. 

 

All entries must be received by 11:59PM EST on September 8, 2022 the day before selection to be eligible. Sponsor will be the official time clock for the Giveaway. Odds of winning depend on number of entries received.  

 

Sponsor is not responsible for lost, late, illegible, corrupted, or misdirected entries.   

 

Must be 21 or older with valid U.S. ID to participate. This Giveaway is open to U.S. residents only. Winners will be selected at random and contacted from a verified Instagram account only via DM. We do not send any registration links from other accounts. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, prize may be forfeited, and an alternate winner selected. By posting on Instagram as part of the Giveaway you agree and accept these Official Rules and your eligibility to participate.   

 

 

  1.  PRIZES AND APPROXIMATE RETAIL VALUES (“ARV”).The following prizes will be awarded: 

 

  • One Eberjey e-gift card valued at $150 to be used on select rose-cloud colored styles 
  • One bottle of Atian Rose Gin including tax, shipping, and handling (approximate value $49.99) 
  • One Mario Badescu e-gift card valued at $150 

 

Additional Prize Details. Winning a prize is contingent upon fulfilling all requirements set forth herein.  Taxes on prize are the sole responsibility of the winner. Prizes are awarded without warranty of any kind from participating brands, Eberjey, Atian Gin or Mario Badescu, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local law or regulation. Prizes are non-transferable and no substitution or cash equivalent is allowed except in Sponsor’s sole discretion. Sponsor reserves the right to substitute prizes of the same or equal approximate retail value. Prize consists only of items specifically listed as part of the prize. Eberjey and Mario Badescu shall deliver the e-gift card via Instagram. Atian Gin will deliver prizes via U.S. mail. Winner must provide valid mailing address or Prize will be forfeited. All costs and expenses not specified herein, related to any prize, are the sole responsibility of the winner. Limit one prize per person. 

 

  1. WINNER SELECTION AND NOTIFICATION: Winners will be selected in a random drawing from among all eligible entries on or about 4:00PM EST on September 9, 2022. Winners will be notified via DM on Instagram and will be required to respond within five (5) days or the prize will be forfeited, and an alternate winner will be chosen. Potential winners are subject to verification of identity, eligibility, to Sponsor’s satisfaction, or may be disqualified and an alternate winner chosen. Eberjey shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within five (5) days from the time award notification was sent, prize may be forfeited and an alternate winner selected. 

 

  1.  PUBLICITY RELEASE. Except where prohibited, acceptance of a prize constitutes winners’ consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.  

 

  1.  By participating, entrant agrees to release and hold harmless Sponsor, Facebook/Instagram, participating dealers and retailers, affiliates, sales representatives, distributors and promotional and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of a prize, participation in any Giveaway-related activity, or participation in the Giveaway. Sponsor is not responsible for the actions of entrants in connection with the Giveaway, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Giveaway. Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

 

Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Giveaway or in the announcement of prizes, including erroneous appearance of qualification for a prize, and under no circumstances will more than the stated number of prizes be awarded. If for any reason Sponsor is prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without further obligation. If Sponsor in its discretion elects to so abbreviate the Giveaway, Sponsor reserves the right, but not the obligation, to award the prize from among all eligible entries received to date. All entries are the property of Sponsor and are not returnable.
