The Softer Side of Life Sleepcation Giveaway Official Rules 

This Eberjey Softer Side of Life Sleepcation (the “Giveaway”) is open to U.S. residents residing in the 48 contiguous states only. You must be 18 or older to win. No purchase necessary.  

The Giveaway starts on May 6, 2024 at 12:01 a.m. est and ends on May 13, 2024 at 11:59 p.m. est.  

Employees of Sponsor and its affiliates, sales representatives, agencies, dealers, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in the promotion, and the immediate family (parent, spouse, sibling, child, grandparent, grandchild) and household members of all such employees, are NOT eligible.  

One winner will be selected at random from all eligible entries and will be contacted on May 14, 2024 via Direct Message to the verified Eberjey Instagram account only via DM to the account used for the qualifying entry.  

This promotion is in no way sponsored by, endorsed by, administered by, or associated with Instagram or Meta.

By entering the Giveaway in accordance with the entry process described above, you will be confirming your eligibility to participate, and registering to receive Instagram communication from Eberjey and agreeing that your registration and any other information collected in connection with the Giveaway may be used by Eberjey in accordance with its Privacy Policy, a current copy of which can be found here https://www.eberjey.com/policy/.  

Sponsor will be the official time clock for the Giveaway. Odds of winning depends on number of entries received. 

The following prize will be awarded:  

• 2-night stay at Shou Sugi Ban House including breakfast, lunch & dinner ($3500 value) 
• SSBH Spa treatment for 2 guests ($550 value) 
• Eberjey Pajamas and lounge to wear throughout your stay ($800 value) 
• True Botanicals product to use throughout your stay ($500 value). 

 All costs and expenses not specified herein are the sole responsibility of the winner. Winner will be liable for all taxes owed.  

If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent via DM, prize may be forfeited and an alternate winner selected. Eberjey shall have no liability for a winner's failure to receive notices due to winners' security settings or for winners' provision of incorrect or otherwise non-functioning contact information. Winner will need to provide valid phone number and address to claim prize. 

Giveaway is subject to all federal, state and local laws and regulations. Void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement and acceptance of these Official Rules and of the decisions of Eberjey which are final and binding on all matters pertaining to this Giveaway.   

Prizes are awarded without warranty of any kind from Eberjey, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local law or regulation. Prizes are non-transferable and no cash equivalent is allowed except in Sponsor’s sole discretion. 

Except where prohibited, acceptance of a prize constitutes winners’ consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.   

By participating, entrant agrees to release and hold harmless Sponsor(s) and Meta, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of a prize, participation in any Giveaway related activity, or participation in the Giveaway.  Sponsor is not responsible for the actions of entrants in connection with the Giveaway, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Giveaway. Sponsor is not responsible for any technical difficulties or errors.  

Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Giveaway or in the announcement of prizes, including erroneous appearance of qualification for a prize, and under no circumstances will more than the stated number of prizes be awarded. If for any reason Sponsor is prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without further obligation. If Sponsor in its discretion elects to so abbreviate the Giveaway, Sponsor reserves the right, but not the obligation, to award the prize from among all eligible entries received to date..  

WARNING:  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right, in its sole discretion, to cancel or suspend this promotion should virus, bugs or other causes beyond its control corrupt the administration, security or proper administration of this promotion.
