California Privacy Notice
This Privacy Addendum for California Residents (“Privacy Addendum”) supplements the information contained in Eberjey Privacy Policy that this is attached to and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice. Personal Information that is regulated under the CCPA may represent a limited portion of personal data as described in the Eberjey Privacy Policy; therefore, this Privacy Addendum applies solely to the Personal Information as defined below. We may update this Privacy Addendum for California Residents as necessary and in the event of changes in the CCPA. Note that this notice does not apply to our personnel. Please contact your supervisor if you are personnel and would like additional information about how we process your personal information.
INFORMATION WE COLLECT
We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information” or “Personal Data”). In particular, Eberjey collects and has collected Personal Information, as provided below.
Categories of Personal Information Eberjey has collected in the preceding twelve (12) months:
• Identifiers (e.g. name, mailing address, email address, phone number, birthdate, online account login information, unique personal identifier, online identifier, or other similar identifiers)
• Characteristics of protected classification (e.g., age)
• Commercial information (e.g. records of products purchased, obtained, or considered, or other purchasing or consuming histories or tendencies, payment card information, marketing preferences)
• Internet or other similar network activity (e.g. IP address, device ID, device specifications, operating system, browsing history, search history, information on a consumer’s interaction with a website, email, application, or advertisement)
• Geolocation data (e.g. as non‑precise geographic location indicators from mobile devices or IP address‑derived approximate geolocation)
• Audio, visual, and electronic information (e.g. call recordings, chat transcripts, email correspondence, testimonials, pictures, videos)
• Inferences drawn from other Personal Information (e.g. profile reflecting a person’s preferences)
Some of the Personal Information listed above may further be considered “Sensitive Personal Information” under the CCPA, specifically, Eberjey account login credentials. Additionally, some of the Personal Information listed above may be considered “personal information” as defined in Cal. Civ. Code § 1798.80(e).
Personal Information does not include information that is:
(a) publicly available information from government records;
(b) deidentified or aggregated consumer information; or
(c) certain information excluded from the scope of CCPA, including the Fair Credit Reporting Act (FRCA), the Gramm‑Leach‑Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
Categories of sources from which Eberjey has collected Personal Information:
• Directly from you. For example, from forms you complete when purchasing a product
• Indirectly from you. For example, from our operating systems and platforms
• Affiliates, parents, and subsidiary organizations of Eberjey
• Service providers
• Business partners who we partner with to offer our products
• Advertising networks
• Other Eberjey customers
USE OF PERSONAL INFORMATION
We may use or disclose the Personal Information we collect for one or more of the following business purposes:
• To present our website and its contents to you.
• To personalize your site experience and to allow us to deliver the type of content and product offerings in which you are most interested.
• To allow us to better service you in responding to your customer service requests.
• To quickly process your requests, transactions, purchases, and payments.
• To administer a contest, promotion, survey, or other site feature.
• To inform you about our services, products, and special promotions.
• To investigate and respond to inquiries and complaints.
• To improve and secure our website and systems.
• To produce aggregated data that does not identify you.
• Fraud monitoring and prevention.
• To provide customers that sign‑up for our email list advance notice of sales, new arrivals, sample sale dates, and other Eberjey news.
• To fulfill any other purpose for which you provide it.
• To provide you with notices about your account and product purchases.
• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
• To notify you about changes to our website or any products or services we offer or provide through them.
• Uses we believe to be necessary or appropriate under applicable law.
• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Eberjey assets.
We may also create or obtain aggregated or anonymized information that is no longer personal data. We may use and disclose aggregated or anonymized information for any purpose in compliance with applicable laws. We will not attempt to re‑identify the individuals associated with aggregated or anonymized information.
Eberjey will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
SALE AND SHARING OF PERSONAL INFORMATION
In the past twelve (12) months we have shared the following categories of Personal Information with third‑party advertising, marketing, promotional partners to facilitate targeted or cross‑context behavioral advertising:
• Identifiers
• Characteristics of protected classification
• Commercial information
• Internet or other similar network activity
• Geolocation data
• Audio, visual, and electronic information
• Inferences drawn from other personal data
We have not sold Personal Information to third parties in the past twelve (12) months.
In the past twelve (12) months we have disclosed Personal Information for a business purpose to:
• Law enforcement or governmental agencies
• Parties to litigation in response to a subpoena or other lawful request
RIGHT TO OPT‑OUT OF SALE OR SHARING OF PERSONAL INFORMATION
You have the right to direct us not to sell your personal data to third parties or to share it with third parties for targeted or cross‑context behavioral advertising purposes. We will process requests within 15 business days, subject to any applicable exceptions and extensions permitted by law.
You may submit a request by email to privacy@eberjey.com, by calling us at 877 323 7539, or by using our online form.
We will also recognize and process browser‑based opt‑out signals such as Global Privacy Control. If we are able to reasonably associate a browser‑based opt‑out signal with an identifiable consumer, we will treat it as a request to opt‑out of the sale or sharing of that consumer’s personal data as if the consumer made the request using a method above. If we are not able to reasonably associate a browser‑based opt‑out signal with an identifiable consumer, we will treat it as a request to opt‑out of the sale or sharing of that website visitor’s personal data collected while the signal is present. While the signal is present, we will also disable any cookies or other tracking tools present on the website from a third party that may result in the sale of personal data or the sharing of personal data to the third party for targeted or cross‑context behavioral advertising purposes.
HOW LONG DO WE RETAIN PERSONAL DATA?
Your personal data will not be kept longer than necessary and will be deleted, as soon as reasonably possible in view of the purposes for processing your personal data, unless we have an ongoing legitimate reason to do so.

CHANGES TO OUR CALIFORNIA ADDENDUM
We reserve the right to amend this Privacy Addendum as described in our Privacy Policy. When we make changes to this Privacy Addendum, we will inform you of such updates as described in our Privacy Policy.
